Welcome to the QMyVoice application (“QMyVoice App” or the “App”). The App is owned and operated by QMyVoice. (“we”, “us” or “our”). Please read these terms and conditions (“Terms”) carefully before using this App as they govern your use of the App.

By downloading, installing, or using the QMyVoice App, you agree to be bound by these Terms. If you do not accept these Terms, you should not use, or immediately uninstall, the App.

We reserve the right to change, modify, add, or remove portions of these Terms at any time, at our sole discretion. It is your responsibility to check these Terms periodically for changes. Your continued use of the App following the posting of changes constitutes your acceptance and agreement to the changes.

1. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the App on your mobile device solely for your personal use.

2. Eligibility and Registration

To use the QMyVoice App, you must register for an account. By registering for an account, you represent and warrant that (a) all the information you provide is accurate, current, and complete; (b) you are at least 18 years of age, or if you are under 18 years of age, you have obtained parental or guardian consent to use the QMyVoice App; and (c) you have authority to enter into and perform your obligations under these Terms.

3. Restrictions

You agree not to use the App in any way that is unlawful, prohibited by these Terms or not authorized by us. You shall not (and shall not permit any third party to):

a. rent, lease, lend, sell, transfer, redistribute, sublicense or exploit the App or any part of it;

b. copy, modify, adapt, translate, create derivative works or improvements from the App;

c. reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the App or any part thereof;

d. remove, delete, alter, or obscure any trademarks or any copyright, trademark, or other intellectual property in the App;

e. use the App for commercial purposes, including but not limited to providing the App as a service to others;

f. use the App to harass, abuse, stalk, threaten, defame, or otherwise infringe or violate the rights of any other party, including without limitation their privacy or publicity rights;

g. interfere with the proper functioning of the App or any networks, servers, or services connected to, or used in connection with, the App.

4. Intellectual Property Rights

The QMyVoice App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, video, and audio), are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You acknowledge and agree that all intellectual property rights in the App are, and shall remain, our property or the property of our licensors.

5. Disclaimer of Warranties

The QMyVoice App is provided on an “as is” and “as available” basis, without warranty of any kind. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, statutory or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title and non-infringement.

6. Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, exemplary, or consequential damages, including but not limited to lost profits, lost data, or personal injury or property damage, arising out of or in connection with your use of the QMyVoice App, even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless QMyVoice and its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorney’s fees) that arise from or relate to your violation of these Terms or your use of the QMyVoice App.

8. Termination

We reserve the right, without notice and in our sole discretion, to terminate or suspend your right to use the QMyVoice App and to block or prevent your future access to and use of the App.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflicts of law provisions.
